The law isn’t enough, it’s permission that counts

While the CAN-SPAM laws are a step in the right direction for reducing the spam problem, we don’t feel they go far enough. Our definition of spam goes beyond the laws in most countries and encompasses what we believe to be true permission email marketing. Spam is any email you send to someone who hasn’t given you their direct permission to contact them on the topic of the email.

Information Access and Use

HyperMail provides users the opportunity to opt-in and opt-out of receiving e-mail communications from us. This is made available during sign-up for our e-mail lists and in e-mail messages delivered from HyperMail Systems. Users requesting HyperMail e-mail communications may update, amend, or delete personal information by following the Profile Update links present in every HyperMail e-mail communication.

For any list managed by HyperMail, users can use the link in the footer of most e-mail messages. Alternatively, users can reply to an e-mail message according to the instructions at the bottom of the message.

Reporting Spam

Spam is an unsolicited commercial email or an email sent to a recipient who would not have a reasonable expectation of receiving email from the sender. If you have received unwanted, unsolicited email sent via the HyperMail system or purported to be sent via HyperMail, please follow this process to report it:

How we’ll know if you don’t have permission

In the event that HyperMail receives complaints regarding unsolicited email from an HyperMail customer source, the customer will be required to supply the external source of their customer data.

HyperMail has numerous layers of approval and monitoring to ensure you comply with our anti-spam policy. Here’s a few of them:

If we do discover that you’re emailing people without their permission, we will terminate your account with HyperMail immediately.

In the end, it’s really common sense. Take off your marketing hat and put yourself in your recipient’s shoes. If they don’t recognize who you are or aren’t interested in what you’re sending, they’ll think you’re a spammer. It’s that simple.

No old lists, either

When it comes to sending permission-based email, the age of the list matters. If enough time passes between someone initially subscribing to your list and eventually receiving an email from you, permission “expires” as people eventually forget what they’ve signed up for.

If the subscriber do not confirm the confirmation letter after 1 week of subscription, he will be removed instantly.

That’s why we don’t allow sending to any email address that was obtained more than 7 months ago and has *not* received any correspondence from you since that time.

Sharing and Usage

We will never share, sell, or rent individual personal information with anyone unless ordered by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you emails based on your request for information and to contracted service providers for purposes of providing services relating to our communications with you.

Each email sent contains an easy, automated way for you to cease receiving email from us, or to change your expressed interests. If you wish to do this, simply follow the instructions at the end of any email. There is a permanently unsubscribe link.

Protecting your customer lists and data

We do everything we can to make sure your customer lists, email content and response data remains private and confidential. Though we reserve the right to monitor your lists, content and response data from time to time to make sure they comply with our Terms of Use, we will never share, sell or rent your customer data to anyone for any reason. It makes us feel icky just thinking about it.

Security Technology

HyperMail has made a substantial investment in the server, database, backup and firewall technologies to protect our information assets. These technologies are deployed as part of sophisticated security architecture. All data resides in a tightly controlled, secure data center. These investments mean that information about the identity and preferences of individual members is never accessible to anyone outside HyperMail. We will maintain safeguards to protect the security of these servers and your personally identifiable information.

Policy Modifications

We may change this Privacy Policy from time to time. If/when HyperMail makes changes to this privacy statement, we will highlight the changes on our homepage and email users who have given us permission to do so. We will post any changes here, so be sure to check back periodically.
