At HyperMail, we take spam and permission very seriously. By creating an account and agreeing to our Terms of Use, you are also agreeing to this anti-spam policy.

At HyperMail, we respect the privacy needs of our valued customers and members. This Privacy Policy outlines what specific information is gathered on the HyperMail site and how that information is used.

The law isn’t enough, it’s permission that counts
While the CAN-SPAM laws are a step in the right direction for reducing the spam problem, we don’t feel they go far enough. Our definition of spam goes beyond the laws in most countries and encompasses what we believe to be true permission email marketing. Spam is any email you send to someone who hasn’t given you their direct permission to contact them on the topic of the email.
Information Access and Use
HyperMail provides users the opportunity to opt-in and opt-out of receiving e-mail communications from us. This is made available during sign-up for our e-mail lists and in e-mail messages delivered from HyperMail Systems. Users requesting HyperMail e-mail communications may update, amend, or delete personal information by following the Profile Update links present in every HyperMail e-mail communication.
For any list managed by HyperMail, users can use the link in the footer of most e-mail messages. Alternatively, users can reply to an e-mail message according to the instructions at the bottom of the message.
Reporting Spam
Spam is an unsolicited commercial email or an email sent to a recipient who would not have a reasonable expectation of receiving email from the sender. If you have received unwanted, unsolicited email sent via the HyperMail system or purported to be sent via HyperMail, please follow this process to report it:
- Attach a copy of the offending email message to a new email message. If you simply forward the offending message, it will not contain the information we need in order to take action
- Email the message with its attachment to abuse@hypermail.ro
- Please note that we will not respond to your email unless you request otherwise
HyperMail Outbound Mail Server Hostnames and IPv4 Addresses
HyperMail ranges do not change and the IPs are dedicated for each client. In this case only HyperMail sends from these IPs.

What kind of email addresses are OK to send with us?
To send emails to your database with HyperMail, you must have clearly obtained their permission. This could be done through:
- An email newsletter subscribe form on your web site.
- An email newsletter unsubscribe link in your newsletter.
- An privacy policy about your newsletter on your web site.
- An opt-in checkbox on a form. This checkbox must not be checked by default, the person completing the form must willingly select the checkbox to indicate they want to hear from you.
- If someone completes an offline form like a survey or enters a competition, you can only contact them if it was explained to them that they would be contacted by email AND they ticked a box indicating they would like to be contacted, or to came with your email database created with your email newsletter website subscribe form.
- Email sent by an organization with whom the recipient had previously established a relationship, PROVIDED THAT the sender provides a mechanism for recipients to remove themselves from the mailing list.
Basically, you can only ever email anyone who has clearly given you permission to email them specifically about the subject you’re contacting them about.
What kind of email addresses ARE NOT OK to send with us?
Anything outside the examples above doesn’t equal permission in our eyes, but here are some examples to make sure we’re crystal clear. By using HyperMail, you agree not to import or send to any email address which:
- You do not have explicit, provable permission to contact in relation to the topic of the email you’re sending.
- You bought, loaned, rented or in any way acquired from a third party, no matter what they claim about quality or permission. We need to obtain permission with a reconfirmation letter.
- You scraped or copy and pasted from the web. Just because people publish their email address doesn’t mean they want to hear from you.
What content MUST I include in my email?
Every email you send using HyperMail must include the following:
- A single-click unsubscribe link that instantly removes the subscriber from your list. Once they unsubscribe, you can never email them again.
- A single-click link that instantly redirect to the online newsletter version.
- The name and physical address of the sender. If you’re sending an email for your client, you’ll need to include your client’s details instead.
How we’ll know if you don’t have permission
In the event that HyperMail receives complaints regarding unsolicited email from an HyperMail customer source, the customer will be required to supply the external source of their customer data.
HyperMail has numerous layers of approval and monitoring to ensure you comply with our anti-spam policy. Here’s a few of them:
- Until your account has been approved by a member of our team, every email you send will need to be approved.
- Our software is directly integrated into the spam reporting systems for some of the biggest ISP’s like Hotmail and AOL. If you don’t have permission and someone marks your campaign as spam, we’ll know about it the moment that button is pressed. If you receive a complaint rate greater than 0.25% of all recipients ( that’s 25 complaints ) your account will be terminated. This is a generous figure that takes into account false spam reports.
- Our team verifies all large lists imported into our software. Until we’ve given it the all clear, we can’t send to it.
- We monitor blacklists and our abuse accounts all day every day. We can pinpoint who is causing us delivery problems or attracting complaints very easily.
If we do discover that you’re emailing people without their permission, we will terminate your account with HyperMail immediately.
In the end, it’s really common sense. Take off your marketing hat and put yourself in your recipient’s shoes. If they don’t recognize who you are or aren’t interested in what you’re sending, they’ll think you’re a spammer. It’s that simple.
No old lists, either
When it comes to sending permission-based email, the age of the list matters. If enough time passes between someone initially subscribing to your list and eventually receiving an email from you, permission “expires” as people eventually forget what they’ve signed up for.
If the subscriber do not confirm the confirmation letter after 1 week of subscription, he will be removed instantly.
That’s why we don’t allow sending to any email address that was obtained more than 7 months ago and has *not* received any correspondence from you since that time.
Sharing and Usage
We will never share, sell, or rent individual personal information with anyone unless ordered by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you emails based on your request for information and to contracted service providers for purposes of providing services relating to our communications with you.
What do we consider as spam?
- Any email advertising illicit or illegal activities.
- Any message sent to email addresses which were not provided by the recipient, including those collected from newsgroups, web sites, and domain registration information.
- We expressly forbids the transmission of unsolicited commercial email and unsolicited bulk email.
How can you stop receiving email from us or our clients?
Each email sent contains an easy, automated way for you to cease receiving email from us, or to change your expressed interests. If you wish to do this, simply follow the instructions at the end of any email. There is a permanently unsubscribe link.
Protecting your customer lists and data
We do everything we can to make sure your customer lists, email content and response data remains private and confidential. Though we reserve the right to monitor your lists, content and response data from time to time to make sure they comply with our Terms of Use, we will never share, sell or rent your customer data to anyone for any reason. It makes us feel icky just thinking about it.
Security Technology
HyperMail has made a substantial investment in the server, database, backup and firewall technologies to protect our information assets. These technologies are deployed as part of sophisticated security architecture. All data resides in a tightly controlled, secure data center. These investments mean that information about the identity and preferences of individual members is never accessible to anyone outside HyperMail. We will maintain safeguards to protect the security of these servers and your personally identifiable information.
Policy Modifications
We may change this Privacy Policy from time to time. If/when HyperMail makes changes to this privacy statement, we will highlight the changes on our homepage and email users who have given us permission to do so. We will post any changes here, so be sure to check back periodically. However, please be assured that if the Privacy Policy changes in the future, we will not use the personal information you have submitted to us under this Privacy Policy in a manner that is materially inconsistent with this Privacy Policy, without your prior consent.
